Who we are
MarketBar Technologies LLC (“MarketBar,” “we,” “us”) provides dynamic pricing, display, and analytics services for bars. We are the controller of personal data we collect through our website/app and the processor of data we process on behalf of Merchant venues.
Data we collect
Merchant account data: contact names, emails, phone numbers, role, location info.
POS data (from the point‑of‑sale system your venue connects): items, categories, modifiers, base prices, order summaries, discounts, timestamps, and merchant profile/IDs. We never receive card PAN, CVV, or full payment details from any POS.
Telemetry & logs: device/browser data, IP, event logs, diagnostic information.
Support data: messages, attachments, call recordings (if applicable).
Display content: names/prices of items shown on in‑venue screens.
Sources
We collect data from: (a) you; (b) the APIs and webhooks of the POS system your venue connects; (c) analytics/telemetry providers; and (d) publicly available sources (e.g., business listings).
How we use data
Provide, configure, and operate the Service (including pricing updates and analytics).
Authenticate and secure connections (OAuth tokens encrypted at rest).
Improve algorithms and features; develop aggregated, de‑identified insights.
Communicate about updates, billing, and support.
Enforce Terms; comply with law.
Legal bases (if GDPR applies)
Our legal bases include performance of a contract (Art. 6(1)(b)), legitimate interests (Art. 6(1)(f)), consent where required (Art. 6(1)(a)), and legal obligation (Art. 6(1)(c)).
Sharing
We share data with:
Service providers (cloud hosting, logging, email, analytics) under confidentiality agreements;
Your POS provider, to the extent required to operate the integration you connect;
Law enforcement if legally compelled;
Corporate transactions (merger, acquisition) with appropriate safeguards. We do not sell personal data.
Security
We use reasonable administrative, technical, and physical safeguards. OAuth tokens are encrypted at rest; access is role‑based and logged. No method of transmission or storage is 100% secure.
Retention
We retain data while you have an account and for a reasonable period thereafter for backups, dispute resolution, and legal obligations. You may request deletion of exported analytics, subject to our legal requirements.
Your rights
Depending on your location, you may request access, correction, deletion, portability, and objection/limitation. To exercise rights, email privacy@marketbarapp.com . We will verify requests as required by law.
International transfers
If we transfer data internationally, we use appropriate safeguards (e.g., SCCs).
Children
The Service is for businesses; not directed to children under 16.
Changes
We may update this Policy. If changes are material, we’ll notify the account owner or post a notice in‑app.
POS integrations and permissions
MarketBar runs on the point‑of‑sale system your venue already uses. For every integration we request only the minimum permissions the Service needs to read your menu and order flow and to move the prices you authorize. In no case do we request or receive payment card numbers, CVV codes, or full payment details — cardholder data never reaches MarketBar. We do not request customer or employee records from any POS.
The permissions we request from each provider:
Clover
Inventory (Read/Write), Merchant (Read), and Orders (Read). We do not request Customers or Employees permissions, and we do not access payment card PAN, CVV, or full payment details from Clover.
Square
Catalog read and write (to sync your menu and update the item prices you authorize), Orders read (the order counts that drive pricing and your analytics), and Merchant Profile read (your location name and address, shown on the board). We request no customer, payment, or employee scopes.
SpotOn
Read‑only access to business information, menu, and order reporting. The SpotOn integration cannot write to your menu or change your prices.
If we add support for another POS, we will request the minimum permissions that integration requires and update this section.
Website analytics, cookies, and session recording
Our website uses Microsoft Clarity to understand how visitors use the site. Clarity records how you interact with our pages — including mouse movement, clicks, scrolling, and the pages you view — and uses that activity to produce session replays and heatmaps. Clarity may set cookies and use similar technologies to do this. This behavioral data is processed by Microsoft; you can read how Microsoft handles it in the Microsoft Privacy Statement at privacy.microsoft.com. We use this data to improve the website, not to identify individual visitors.
We also use Vercel Web Analytics and Speed Insights, which collect aggregate page-view and performance metrics.
When you submit a form on our site (for example, a demo request), we store the information you enter — including forms you start but do not finish — so we can respond to your inquiry. If you book a demo time, the meeting details are scheduled through Google Calendar.
